Terms & Conditions of Sale

1. Introduction

For simplicity, throughout this notice ‘we’ and ‘us’ means Pure BPM Ltd, trading as Hamalainen UK. Our Registered Office is: Grosvenor House, Chapel Street, Congleton, Cheshire CW12 4AB and we are registered in England & Wales (#12755406).

2. Order Acceptance & Processing

All orders are accepted when your payment is successfully processed. Any email or other acknowledgement of your order is merely to report that your request has been received and will be looked at, and does not in any way denote acceptance of your order regardless of any wording on the email. We reserve the right, at any time prior to acceptance, to refuse any order or any part of an order, or to require additional information to enable us to evaluate and/or process the order.

All specifications are approximate only and we shall have no liability in respect of any deviation there from. We shall have no liability in the event of the goods infringing or being alleged to infringe the rights of any third party. In the event that the goods are or maybe the subject of third party rights, we shall be obliged to transfer any such title we have but without prejudice to the rights of a consumer for a remedy in the event of total or partial non-performance.

3. Deposits

Unless otherwise agreed in writing, all deposits are none-refundable.

4. Cancellation of Orders

If you cancel your order you will be given a cancellation number. If you email a cancellation this number will be emailed to you. You must keep a record of this number. Orders are only cancelled once this number is provided and any claims that an order was cancelled will not be entertained unless a cancellation number can be quoted. In the event of cancellation, unless previously otherwise agreed in writing, any deposit paid will be retained to cover cost of materials, manufacturing and other costs associated with made-to-order products.

5. Delivery of Goods

The delivery of goods to you is deemed to be a separate contract for services, distinct from your contract to purchase the goods. Delivery may be effected in one or more instalments. Changes to the delivery address made by the purchaser after the goods have been handed to the delivery company will incur an additional charge.

Delivery dates are approximate and no liability whatsoever is accepted in respect of late deliveries. Do not arrange for an installer to install the items until after they have been delivered and checked for damage. Delivery is a working day service Monday to Friday. If for any reason expected delivery will exceed 28 days from the date of receipt of order the customer will be informed and will have the opportunity to cancel the order.

In certain circumstances where large bulky items are being ordered for delivery to very remote locations (such as Scottish Islands) there may be an additional carriage charge. If your order falls into this category then you will be notified of the extra cost and given the option of accepting the extra charge or cancelling your order.

Without prejudice to the statutory rights afforded to consumers under law, we accept no liability for any failure to ship products where this results from our inability to do so resulting from acts of god, civil commotion, riots, flood, draught, fire, legislation or other factors outside our control, or our decision on reasonable grounds not to do so for reasons of suspicion of credit card fraud or similar, provided that we take all reasonable steps to notify you within fourteen (14) days of order placement that products will not be shipped as ordered. It is your responsibility to ensure that you order with sufficient lead time to prevent any loss or disappointment resulting from such non-shipment.

If there is a failed delivery due to the customer and not the transport company, we reserve the right to charge the redelivery cost.

6. Pricing Errors

In the event that there is a pricing error on our websites and marketing materials then we will not be bound to honour any orders made at that price.

7. Disclaimers and Limitations on Liability

Without prejudice to statutory rights afforded to purchasers of products, the information and materials contained in our websites and marketing materials, including, without limitation, text, graphics and links, are provided on an "as is" basis with no warranty, and in particular, we do not represent or warrant that the information is accurate, complete or current. Price and availability information is subject to change without notice.

Products purchases from us and related services, which are provided by us, are warranted in accordance with law, and nothing herein is to be taken to exclude or restrict any rights, which applicable law grants to consumers in respect of such products or services. Individual products may be the subject of additional warranties or guarantees given by their manufacturers directly. Such warranties etc. are not enforceable against us but only against the person giving them.

We accept liability for damage to property where and to the extent that it arises from the negligence of us or of our servants and agents, up to a limit, in relation to any one event or series of events arising from a common cause. Of one thousand pounds (£1,000).

Except as provide above there are no other warranties, conditions or other terms, express or implied, statutory or otherwise, and all such terms are hereby excluded to the maximum extent permitted by law.

We accept liability for any indirect or consequential loss if it arises from the negligence of us or of our servants and agents, up to a limit, in relation to any one event or series of events arising from a common cause, of ten thousand pounds (£10,000). We do not accept any liability for any other form of indirect or consequential loss.

8. Checking Goods for Damage and Notifying Us

Please inspect goods upon arrival, look for obvious damages and report to driver. ALL Items Must Be Checked Whilst the Driver is at the Premises If the goods are not in a satisfactory condition mark and sign the paperwork as damaged and do not accept the delivery. Please report this to us immediately (This is essential as if this is not done it could affect your chances of a replacement since the delivery company will not entertain our claims for compensation if the delivery notes are not marked as "damaged").

You are responsible for providing a safe means of access from the public highway to the place of delivery. If our delivery company consider that access is unsafe then we will not deliver the goods until safe access is provided. Any subsequent charges by the courier will be claimed back from the customer.

You agree to open all boxes and thoroughly check the goods for damage or shortage on the day of delivery and notify us of any damage or shortage within 3 working days of the delivery. If we are not notified of damage or shortage within 3 working days we are unable to claim from either the manufacturer or the carrier. You agree to indemnify us in full for any losses we suffer as a result of your failure to notify us within 3 working days.

Returns Policy

If you change your mind about the product when you receive it or if you find it does not match our description you can return it at any time within 14 days for a full refund of the goods cost, or replacement of equivalent value, or a credit against any item of higher value. Please note this is granted as an opportunity to inspect the goods and not a test period; goods for return must be new, unused and in the original packaging. It is your responsibility to ensure that the goods are returned to us in good condition. They should be well packed.

You may have the statutory right to return the product you have purchased within fourteen (14) days of delivery for any reason (including if you simply change your mind). To do so you must notify us in writing or other durable medium (including email) within those fourteen (14) days. You will then be entitled to a refund from us, which will be paid within thirty (30) working days of your notice of cancellation. Such cancellations are subject to clause 4 of these Terms and Conditions and may not apply to certain products (e.g. perishable goods, or made-to-order items).

It is your responsibility to ensure goods are complete, unused, and in 'AS NEW' condition (e.g. if you or the carriers have opened the box to examine the product it must have been done so without damaging the box and packaging or damaging the product in any way and must be re-packaged as received and the packaging sufficient to re-sell the item as brand new Please note if these requirements aren’t met you may be charged for an unfair return. If the carriers unwrap this box the responsibility to ensure the packaging remains intact is with the customer. Please do not allow carriers or any other party to destroy any packaging, the packaging is specifically designed for each piece and is deemed as part of the item.

Returns must be made with a valid returns number. You must contact us to request a returns number so that we know to expect your return. Any return that is received without a returns number will not be processed.

We will refund the full cost of the goods and the transport charges as follows; for mainland England and Wales we will refund the delivery charges and arrange for and pay the return charges, for mainland Scotland we will refund the delivery charges but not the return charges, all other addresses we will refund only goods cost only. Your Statutory Rights are not affected.

In limited circumstances we may be prepared to take back items that are new and unused goods after the 14 day inspection period subject to a restocking charge, in these circumstances we will not refund the original delivery charge or pay for the return transport. The restocking charge will be quoted prior to acceptance of return and issuance of a returns number.

Sauna Cabin Assembly

Please note that sauna cabins do not come with a floor and is erected onto the existing floor that can be vinyl, ceramic, concrete or wood but not carpet (for wooden floors it may be necessary to provide a drip tray below the heater if a lot of water is poured over the rocks) the floor should be level.

Traditional rock sauna heaters must be wired to an all pole isolator.

We recommend that a suitably qualified electrician carries out all the electrical wiring work for both the heater and any internal lighting. The lighting circuit will require a separate feed from the heater e.g. from the room lighting circuit. For remote controls both the heater and the control must be wired by the electrician in accordance with the instructions provided.

Infra Red Cabins – 13amp supply (two separate sockets will be required for combined steam and infrared.)

Please note:

  1. All sauna, infrared and stauna cabins are for indoor use only.
  2. All measurements are external measurements and are + or - 10mm. Please allow for a minimum 25mm air gap all around all cabins.
  3. Saunas do not come with flooring. Sauna is supplied with pre-cut timber to create a floor to cover the area in front of the benches and underneath the heater which is then placed on top of your existing flooring. Saunas can be erected onto the existing floor that can be vinyl, ceramic, concrete but not carpet or wood.
  4. Traditional rock Sauna heaters do not operate from a 3 pin plug, they require hard wiring using high temperature silicon rubber cable to BSEN 6141. (not included) Electricians can normally obtain this from their supplier. The length required depends upon the distance between the control box and the heater.
  5. All Infrared cabins require a 13amp socket but must not run off an extension lead.
  6. Infrared Stauna will require two 13amp sockets and must not be operating off an extension lead.

Please advise in advance of delivery any restrictions such as stairways, narrow corridors or doorways etc. if you live in a flat, or of any parking or vehicle access difficulties.
